Terms and Conditions of Sale

These Terms and Conditions govern the sale of goods by Koch & Co Decor (“we,” “us,” “our”) to you, the customer (“you,” “your”), through our website or other sales channels. By placing an order, you agree to be bound by these terms.

1. Agreement and Orders

All orders are offers to purchase goods subject to these Terms. We reserve the right to accept or decline any order at our discretion. An order is only accepted, and a contract formed, when we issue an Order Confirmation or dispatch the goods. We may cancel any order before dispatch.

2. Pricing and Payment

All prices are in Australian Dollars (AUD). We reserve the right to change prices without notice. While we strive for accuracy, errors may occur; we are not bound by an incorrect price and may cancel an order arising from such an error. Payment is due as per the selected method at checkout. For approved credit accounts, payment is due within 30 days of the invoice date.

3. Delivery and Risk

Delivery timeframes are estimates only. We are not liable for delays caused by factors outside our control. The risk in the goods passes to you upon delivery to the nominated address or upon collection. It is your responsibility to inspect goods upon receipt and note any transport damage on the carrier’s consignment note immediately.

4. Returns, Refunds, and Faulty Goods

Returns are governed by our separate Returns Policy, available on our website. Please review this policy for eligibility, timeframes, and processes. We comply with applicable Australian Consumer Law guarantees. For goods with a major failure, you are entitled to a refund or replacement. For non-major failures, we may offer repair or replacement.

5. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim arising from these Terms or your use of the goods is limited, at our option, to: (a) the replacement or repair of the goods; (b) the resupply of the services; or (c) the payment of the cost of having the goods replaced or repaired. We are not liable for any indirect, special, or consequential loss.

6. Intellectual Property

All content on our website, including text, graphics, logos, and product designs, is our property or licensed to us and protected by copyright and trademark laws. You may not use, reproduce, or distribute any content without our prior written permission.

7. Privacy

8. Credit Accounts and Personal Guarantee

If a credit account is granted, the individual(s) or director(s) providing the guarantee are personally liable for all debts incurred by the trading entity. This is a continuing guarantee for the duration of the account.

9. General Provisions

These Terms constitute the entire agreement. If any part is found invalid, the remainder continues in force. Our failure to enforce a provision is not a waiver. These Terms are governed by the laws of New South Wales, Australia.
